1. Introduction
These Terms and Conditions ("Agreement") govern the use of the website www.scubagirlsbh.com and the purchase of any products (including, but not limited to, prints, digital art, and merchandise) offered through the site (collectively, the "Services"). This website is owned and operated by Scubagirlsbh/ Liza Blanchard ("The Artist," "We," "Us," or "Our").
By accessing or using our Services, you agree to be bound by these T&Cs. If you disagree with any part of the terms, then you may not access the Services.
2. General Conditions of Sale
2.1 Eligibility
By placing an order, you warrant that you are at least 18 years old or are placing an order with the permission and supervision of a parent or guardian.
2.2 Product Descriptions
We endeavor to be as accurate as possible with product descriptions and images. However, due to the nature of digital screens and printing processes, slight variations in color, saturation, or finish between the image viewed online and the physical print may occur. Such minor variations shall not constitute a defect or breach of warranty.
2.3 Pricing and Availability
All prices are listed in Euros (EUR). Prices are subject to change without notice. We reserve the right to limit the quantities of any products or services that we offer.
3. Orders and Payment
3.1 Order Acceptance
All orders are subject to acceptance and availability. Upon placing an order, you will receive an email confirmation. This email does not constitute acceptance; it confirms that we have received your request. Acceptance occurs when the order is shipped.
3.2 Payment
Payment can be made by Visa, Mastercard, PayPal. You confirm that all details you provide to us for the purpose of purchasing goods or services are correct and that the payment method is legally owned by you.
4. Shipping and Delivery
4.1 Processing Time
Orders for physical prints require a certain amount of processing and printing time, typically 10 to 20 business days, before shipment.
4.2 Shipping Costs
Shipping costs are calculated based on the size, weight, and destination of the order and will be displayed at checkout.
4.3 Risk of Loss
Risk of loss and title for items purchased from us pass to you upon our delivery to the carrier. We are not responsible for delays, damage, or loss caused by the shipping carrier.
4.4 International Shipping
The customer is solely responsible for any customs duties, taxes, tariffs, or fees imposed by their country's customs department upon delivery.
5. Returns, Refunds, and Cancellations
5.1 Cancellation Policy
Orders may be cancelled within 24 hours of purchase, provided the printing/processing has not yet begun. After this period, the order cannot be cancelled.
5.2 Damage and Defects
If your product arrives damaged or defective, you must contact us at scubasbh@gmail.com within 7 days of delivery, providing photographic evidence of the damage. We will then arrange for a replacement or a full refund.
5.3 Returns (Change of Mind)
Due to the custom nature of art prints, we do not accept returns or offer refunds based solely on a "change of mind" or aesthetic preference. All sales are considered final unless the item is defective or damaged upon arrival.
6. Intellectual Property and Copyright
6.1 Ownership
All images, photographs, designs, logos, text, and other content on this website are the sole property of The Artist (Liza) and are protected by international copyright laws.
6.2 License for Prints
The purchase of a physical print or digital file does not transfer copyright. The Artist retains all rights, title, and interest in and to the photography. The purchased print is for personal display use only.
6.3 Prohibited Use
You are prohibited from:
• Reproducing, copying, or distributing the image (digitally or physically) for commercial gain.
• Using the image for any commercial or promotional purpose without purchasing a separate, explicit Commercial License from The Artist.
7. Governing Law
These Terms and Conditions and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law principles.
